What is “Pre-Trial Intervention” (PTI)?
PTI is a diversion program for first-time offenders. It is an eighteen-month drug program. It is a voluntary agreement between the State of Florida and the person arrested. Successful completion of the program results in the charges being voluntarily dismissed by the State of Florida.
Am I eligible for PTI?
First-time offenders are eligible for PTI if they are charged with any kind of felony of the third degree – e.g., Grand Theft or Possession.
I was charged with a Drug offense. Is PTI available for drug charges?
Yes, it is referred to as Drug Court PTI. It is a similar program with an emphasis on rehabilitation. Therefore, Drug PTI is a rehabilitation program for “users” and not for “sellers.” Charges like Delivery of a Controlled Substance and Trafficking are not usually eligible. Successful completion of the program results in the charges being voluntarily dismissed by the State of Florida.
What if I am charged with a misdemeanor?
If you are charged with a misdemeanor there is a diversion program called the Misdemeanor Intervention Program (MIP). This program is shorter, generally three to six months, and also results in the charges being dismissed if you qualify and successfully complete the program.
