MOTIONS IN CRIMINAL CASES

Many different motions are available for criminal defendants.  They range from motions for pretrial release, motions for continuance, motions to compel discovery, as well as motions to suppress illegally obtained confessions or items (like drugs, etc).  Florida Rule of Criminal Procedure 3.190 covers most of the common motions and their requirements, and additional authority for motions is found in Rules 3.131 and 3.132 (pretrial release and detention) and Rule 3.220 (discovery).

Note, not every case is factually driven such that a motion to suppress, or any other motion for that matter, can be filed.  However, a creative attorney can find issues that merit motion practice.
